Upon DUI conviction, many jurisdictions require the installation of an ignition interlock device (IID) in all vehicles operated by the defendant. The IID is a mechanism connected to the vehicle’s ignition to measure ethanol within a person’s breath. When a driver blows into the devise and the ethanol level exceeds a pre-programmed BAC result, the vehicle’s ignition will not function. Some IIDs require constant monitoring of breath-ethanol levels, even while the vehicle is operating.
The period of installation usually parallels the length of a driver’s license suspension, though it can extend up to the maximum term of incarceration allowed by statute. The IID is often required for a temporary restricted license. Failure to install the device within a reasonable time period can result in contempt of court, and tampering with the device is a criminal offense punishable by jail or fine.
